1.2 We strongly recommend that all Terms and Conditions are read in-depth before engaging in a service agreement with Misfits Recruitment or using our website and linked platforms.
1.3 By accessing this website or obtaining services from Misfits Recruitment, you confirm that you have read, understood, and agree to be bound by these terms.
1.4 If you do not agree to these terms, please cease use of the website and services immediately.

2.1 This website shall be used for lawful purposes only. Any use that breaches local or international laws, or is fraudulent in nature, is strictly prohibited.

3.1 Misfits Recruitment operates on a "Content over Cover" philosophy. As such, all candidates may be required to undergo rigorous testing.
3.2 Testing includes, but is not limited to, IQ assessments, technical skill evaluations, English proficiency exams, and job-specific competency tests.
3.3 By participating in these tests, you agree that Misfits Recruitment may store and analyze your results for recruitment purposes.
3.4 While we provide "Real Feedback" as a core value, all assessment results and feedback are the professional opinion of Misfits Recruitment and are provided "as is" without a guarantee of employment.
3.5 Any attempt to manipulate test results, use unauthorized aids, or misrepresent your identity during the assessment process will result in immediate disqualification and a permanent ban from our network.
4.1 Use of this website is also governed by our Privacy Policy and Cookie Policy, which should be read in full before committing to a service with us.
5.1 Misfits Recruitment is the sole operator and lawful owner of all content, logos, phrases, graphics, and data on this website.
5.2 All data and designs are constituted as trademarks of Misfits Recruitment, whether registered or unregistered.
5.3 Any unauthorized copying, transferring, or altering of this data is strictly prohibited.
6.1 While we strive for accuracy, we cannot guarantee the completeness of all information presented.
6.2 Misfits Recruitment excludes liability for any loss or damage incurred as a result of reliance on the information provided by this website.

7.1 Any attempt to hack or insert viruses (including worms, trojans, or logic bombs) into our database or website is a criminal offense. All breaches will be reported to the relevant authorities under applicable cybersecurity laws.
8.1 Misfits Recruitment offers pre-employment testing services to companies and recruitment agencies ("Clients") through credit-based packages and job posting bundles.
8.2 Credits are purchased in advance and entitle the Client to a specified number of candidate assessments. Each credit represents one candidate completing one test session.
8.3 Credits are valid for 12 months from the date of purchase. Unused credits expire at the end of this period and are non-refundable.
8.4 Credit packs are non-transferable between Client accounts unless agreed in writing by Misfits Recruitment.
8.5 If a candidate’s test session is invalidated due to confirmed cheating or technical failure on our part, the credit used for that session will be restored to the Client’s account.
9.1 All prices are quoted in Euros (EUR) unless otherwise agreed in writing.
9.2 Payment for credit packs and job posting bundles is due upon invoice. For enterprise clients with an active Service Agreement, payment terms of net 30 days from invoice date may apply.
9.3 Late payments may incur interest at a rate of 1.5% per month on the outstanding balance, calculated from the due date until full payment is received.
9.4 We reserve the right to suspend access to our testing platform if payments remain outstanding beyond 14 days of the due date.
9.5 All fees are exclusive of applicable taxes (VAT). Where VAT applies, it will be added to the invoice in accordance with Romanian and EU tax regulations.
10.1 Credit packs that have not been used may be refunded within 14 days of purchase, in accordance with EU consumer protection regulations, provided no credits have been consumed.
10.2 Once a credit has been used (a candidate has started a test), the remaining unused credits within that pack are non-refundable.
10.3 If our platform experiences a technical failure that prevents a candidate from completing a test, the affected credit will be restored at no charge.
11.1 Clients are responsible for ensuring they have a lawful basis to submit candidate data to our platform for testing purposes.
11.2 Clients must inform their candidates that they will be assessed through the Misfits Recruitment platform, and ensure candidates have provided appropriate consent where required.
11.3 Clients shall not share, redistribute, or resell test content, questions, reports, or scoring methodologies obtained through our platform.
11.4 Clients are responsible for their own hiring decisions. Test results provided by Misfits Recruitment are one factor to assist in evaluation and do not constitute a hiring recommendation.
12.1 Test results and reports are provided to the Client for their internal recruitment and evaluation purposes only.
12.2 Clients may share individual test reports with relevant internal stakeholders involved in the hiring process, but may not publish, distribute, or make reports publicly available.
12.3 Test results remain accessible to the Client through our platform for 12 months from the date of the assessment. After this period, results may be archived or deleted.
12.4 Misfits Recruitment does not guarantee that test results predict future job performance. Results reflect a candidate’s performance on the specific assessment at the time it was taken.
13.1 Our platform employs automated monitoring measures during assessments, including but not limited to: fullscreen enforcement, tab switch detection, browser focus monitoring, and per-question time tracking.
13.2 If our system detects potential integrity violations during a test session, these are recorded and reported to the Client alongside the test results.
13.3 The interpretation of violation reports and any decision to disqualify a candidate rests with the Client. Misfits Recruitment provides the data; the Client makes the decision.
13.4 Candidates who are confirmed to have cheated may be permanently banned from our platform at the discretion of Misfits Recruitment.
14.1 We aim to maintain the availability of our testing platform at all times. However, we do not guarantee uninterrupted access and may occasionally need to perform maintenance or updates.
14.2 Where planned maintenance is expected to affect service availability, we will provide reasonable advance notice to active Clients.
14.3 Misfits Recruitment shall not be liable for any loss or damage arising from temporary unavailability of the platform, except where credits are consumed due to a technical fault, in which case they will be restored.
15.1 All test questions, assessment methodologies, scoring algorithms, reports, and related content are the exclusive intellectual property of Misfits Recruitment.
15.2 Clients are granted a limited, non-exclusive, non-transferable license to use test reports solely for their internal recruitment purposes during the term of their service agreement.
15.3 No part of our test content may be reproduced, reverse-engineered, recorded, screenshotted, or distributed in any form without prior written consent from Misfits Recruitment.
15.4 Candidates and Clients acknowledge that test questions are confidential. Any attempt to extract, memorize for redistribution, or share test content constitutes a material breach of these terms.
16.1 Misfits Recruitment provides assessment and testing services only. We do not make hiring decisions and are not liable for any consequences arising from a Client’s hiring decisions, whether or not those decisions were informed by our test results.
16.2 Our total liability arising out of or in connection with these terms or the use of our services shall not exceed the total amount paid by the Client in the 12 months preceding the event giving rise to the claim.
16.3 To the fullest extent permitted by law, Misfits Recruitment shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities.
16.4 Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
17.1 Neither party shall be liable for any failure to perform its obligations under these terms where such failure results from circumstances beyond the reasonable control of that party, including but not limited to: natural disasters, war, terrorism, pandemic, government actions, power failures, internet outages, or cyberattacks.
17.2 The affected party shall notify the other party as soon as reasonably practicable and shall use reasonable efforts to mitigate the effects of the force majeure event.
18.1 Either party may terminate a service agreement by providing 30 days’ written notice to the other party.
18.2 Misfits Recruitment may terminate or suspend a Client’s access immediately if the Client breaches any material term of these conditions, including non-payment, misuse of test content, or unauthorized redistribution of reports.
18.3 Upon termination, any unused credits that have not yet expired remain available until their original expiry date, unless termination is due to a breach by the Client, in which case unused credits are forfeited.
18.4 Sections relating to intellectual property, limitation of liability, and governing law shall survive termination of these terms.
19.1 In the event of any dispute arising out of or in connection with these terms, the parties shall first attempt to resolve the matter through good faith negotiation within 30 days of written notice of the dispute.
19.2 If the dispute cannot be resolved through negotiation, it shall be referred to and finally resolved by arbitration in accordance with the rules of the International Chamber of Commerce (ICC). The seat of arbitration shall be Bucharest, Romania, and the language of the proceedings shall be English.
19.3 Nothing in this clause prevents either party from seeking urgent interim or injunctive relief from any court of competent jurisdiction.
20.1 These terms and conditions are governed by and construed in accordance with the laws of Romania.
20.2 The application of the United Nations Convention on Contracts for the International Sale of Goods is excluded.
20.3 Where any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
21.1 We reserve the right to amend these Terms and Conditions at any time. Changes will be posted on this page with an updated revision date.
21.2 For Clients with active service agreements, material changes to these terms will be communicated by email at least 14 days before they take effect.
21.3 Continued use of our website or services after changes have been posted constitutes acceptance of the amended terms.
